1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Simply Arrows app (the "Services"). By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

2. Use of Our Services

License to Use

GoldenGem Creations grants you a personal, non-exclusive, non-transferable, and revocable license to access and use the Services strictly for your personal, non-commercial entertainment.

Age Restrictions

Our Services are intended for a general audience. You must be at least 13 years old to use our Services. If you are between 13 and the age of majority in your jurisdiction, you must have the permission of a parent or legal guardian to use our Services.

3. Accounts and Cloud Saves

• To utilize our Cloud Save feature, you may be required to log in using a third-party service (such as Google Sign-In).
• You are responsible for maintaining the confidentiality of your login credentials.
• We reserve the right to suspend or terminate your access if we suspect unauthorized or fraudulent activity.
• You may request the deletion of your cloud data at any time via the in-app Settings menu.

4. Virtual Items, Purchases, and Advertising

Our games may include virtual currencies (such as Gems), lives, hints, time extensions, or other virtual items ("Virtual Items"). Every level and every mode in Simply Arrows can be played for free, in full, without ever buying anything or watching an ad. Virtual Items are entirely optional conveniences.

• Ad-Supported Rewards: You may earn Virtual Items by choosing to watch in-app advertisements (provided via Google AdMob). Ads are never shown without your consent and never required to progress.
• Optional Purchases (Gem Packs): You may also choose to buy Gem Packs with real money. Purchases are processed through Google Play Billing, with purchase management handled by our payments partner, RevenueCat. Prices are set in your local currency and displayed in the Google Play Store at the time of purchase.
• Payment & Refunds: All billing, invoicing, and refund requests for real-money purchases are handled by Google Play under its own terms and refund policies. We do not directly process or store your payment details.
• No Real-World Value: Virtual Items, including Gems, have no real-world monetary value and cannot be redeemed, exchanged, or transferred for cash, real-world goods, or services, except as required by law.
• Revocation: We reserve the right to manage, regulate, control, modify, or eliminate Virtual Items at any time, with or without notice.

5. Prohibited Conduct

While we encourage creative puzzle-solving, you agree not to engage in any of the following activities:

• Cheating and Hacking: Modifying, reverse-engineering, decompiling, or attempting to extract the source code of our apps.
• Exploitation: Exploiting errors in design, undocumented features, or bugs to gain access that would otherwise not be available. (Note: Using standard background timer mechanics for life regeneration is permitted.)
• Ad Abuse: Using automated systems, bots, or software to artificially inflate ad views or manipulate the in-app advertising system.
• Disruption: Interfering with or disrupting our servers, networks, or the enjoyment of the Services by other users.

6. Intellectual Property

All rights, title, and interest in and to the Services (including but not limited to games, titles, computer code, themes, objects, characters, artwork, animations, sounds, and UI design) are owned by GoldenGem Creations. You may not copy, distribute, modify, or create derivative works of our content without our express written permission.

7. Third-Party Services

Our Services incorporate third-party tools, including Google Firebase (Authentication, Firestore, Cloud Functions, Cloud Messaging, Crashlytics, and Analytics), Google AdMob, Google Play Billing, Google Play Games Services, and RevenueCat (for purchase processing). Your interactions with these third parties are governed by their respective Terms of Service and Privacy Policies. GoldenGem Creations is not responsible for the practices of these third parties.

8. Disclaimer of Warranties

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, GoldenGem Creations disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or free from viruses.

9. Limitation of Liability

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees, or any other rights you have under the laws of the place where you live.

To the maximum extent permitted by law, GoldenGem Creations shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of (or inability to access or use) the Services.
• Any conduct or content of any third party on the Services.
• Any unauthorized access, use, or alteration of your cloud saves or data.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Queensland, Australia.

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
