Terms of Use

These terms apply when you use the Gift Tracker app for Android, made by GoldenGem Creations ("we", "us"), ABN 85 072 632 232, Queensland, Australia. By installing or using Gift Tracker you agree to them; if you don't, please don't use the app.

1. Using Gift Tracker

We give you a personal, non-exclusive, non-transferable licence to use Gift Tracker for your own, non-commercial purposes. You need to be old enough to have your own Google account to sign in; anyone under the age of majority where they live should have a parent's or guardian's permission.

2. Your account

You sign in with your Google account and are responsible for keeping it, and the phones you use Gift Tracker on, secure.
Gift Tracker can also be used without an account, in which case your lists exist only on that phone.
You can delete your account at any time in the app (Settings → Security & account → Delete account), or as described on our Delete account page.
We may suspend an account that's being used to break these terms or to attack or overload our service.

3. Your lists and what you share

Everything you put in Gift Tracker remains yours. We claim no rights to it, and because it's end-to-end encrypted we can't read it.
When you share a list, its members can see and (depending on their role) change its contents. Only share with people you trust, and only add details about other people that you're comfortable sharing with the list's members.
An owner or member with full control can remove members. If you leave a shared list, or delete your account, the list and the gifts you added to it stay with its other members.
You're responsible for what you add, and must not use Gift Tracker for anything unlawful.

4. Encryption, recovery codes and lost data

Because your lists are encrypted with keys we never have, we cannot recover them for you. If you lose your recovery code and passkey, and every phone you were signed in on, the lists only you could open can't be brought back. If you share a list, another member can simply invite you again. Without an account, your lists exist only on that phone unless you keep a backup file.

Please keep your recovery code somewhere safe, such as a password manager, and back up phone-only lists.

5. Free to use, and optional support purchases

Gift Tracker is free, with every feature available to everyone and no ads. You can choose to buy optional "thank-you" items to support the developer. They unlock nothing, are consumed straight away, and are entirely voluntary. Purchases are made through Google Play at the price shown there, and refunds are handled by Google Play under its refund policies.

6. Product lookups and other services

Product details found from a barcode or link come from third parties (public product databases and shops). We don't control them and can't guarantee that names, prices or pictures are accurate or current. Gift Tracker also relies on Google services (Firebase, Google Play and Google sign-in), whose own terms apply to your use of them.

7. Acceptable use

Please don't reverse-engineer or tamper with the app or our servers, try to access lists or accounts that aren't yours, use automated tools against our service, or interfere with other people's use of it.

8. Changes and availability

We're continually improving Gift Tracker, so features may change. We aim to keep the service running, but can't promise it will always be available or error-free. If we ever stop running the sync service, we'll give reasonable notice so you can export your lists.

9. Our responsibility to you

Our goods and services come with guarantees that can't be excluded under the Australian Consumer Law, and nothing in these terms limits them or any other rights you have under the law where you live.

Otherwise, Gift Tracker is provided "as is". To the extent the law allows, we're not liable for indirect or consequential loss, such as a missed gift or occasion, or for data lost because a recovery code or device was lost. Where our liability can be limited, it's limited to resupplying the service or, for a purchase, refunding what you paid.

10. Intellectual property

Gift Tracker, its name, logo, design and code belong to GoldenGem Creations. Your lists belong to you.

11. Changes to these terms

We may update these terms. We'll change the effective date above and, for significant changes, let you know before they take effect. If you keep using Gift Tracker after a change, the updated terms apply.

12. Governing law

These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction, without taking away any rights you have to bring a claim where you live.
